Does child support affect my ODSP?
No. Since January 1, 2017, child support payments are fully exempt as income and do not impact your ODSP eligibility or benefit amount. You receive the full child support amount on top of your ODSP payment.
Does spousal support affect my ODSP?
Yes. Spousal support is treated as income and is deducted dollar-for-dollar from your ODSP payment. However, your overall income may still increase.
How is a global support order treated?
If child and spousal support amounts can be distinguished in the order, a fixed ratio is applied. The child support portion is exempt, and the spousal support portion is deducted. If the amounts cannot be distinguished, the entire amount is treated as exempt.
Do I need to pursue child support?
No. Since January 1, 2017, ODSP recipients are no longer required to pursue child support as a condition of eligibility.
Do I need to pursue spousal support?
Yes, generally. ODSP recipients are required to make reasonable efforts to obtain spousal support unless a waiver is granted. Waivers may be approved for situations involving domestic violence, an absent spouse who cannot be located, or other special circumstances.
What about retroactive child support payments?
Retroactive child support payments are applied to the period for which they are intended. If the period is on or after January 1, 2017, they are exempt. If before that date, they are treated as income and deducted.
Can I get a waiver from pursuing spousal support?
Yes. A waiver may be granted temporarily or permanently for situations such as domestic violence, inability to locate the absent spouse, the spouse being incarcerated, or other special circumstances.
What if my ex-spouse is violent?
ODSP can waive the requirement to pursue spousal support if there is an ongoing risk of domestic violence. You may need to provide evidence such as a police report, restraining order, or letter from a doctor or counsellor.
How do I report support payments to ODSP?
You must report any changes in child or spousal support to your caseworker. If the amount hasn't changed, you don't need to report monthly. You may need to provide a copy of the court order or agreement.
What is the Family Responsibility Office (FRO)?
The FRO enforces court-ordered spousal support payments. It receives every spousal support order made by a court in Ontario and has the legal authority to collect payments and arrears.
