What is banked time? Instead of paying overtime at 1.5ร, an employer with a written overtime agreement can bank time off at 1 hour per 1 overtime hour (after September 1, 2019). Before that date, the ratio was 1.5 hours per 1 OT hour.
When does banked time have to be used? Employees must use banked time within 6 months of the end of the pay period in which it was earned. Exceptions exist if a collective agreement specifies otherwise.
Usage limits: Banked time must be taken during non-overtime hours. That means:
What if banked time isn't used in time? It must be paid out at 1.5ร the regular rate at the time it was earned.
Termination: Any unused banked time must be paid out at 1.5ร at the end of the last day of employment.
Change of ownership: A sale of business doesn't break the employee's banked time. The previous owner pays accumulated OT; the new owner grants the banked time.
The following employees are NOT eligible for overtime hours and overtime pay under the Alberta ESC:
Overtime begins after 8 hours in a day OR 44 hours in a week, whichever is greater. This is called the 8/44 rule. Overtime is the greater of the daily total or weekly total.
Overtime pay is at least 1.5ร the regular wage rate for all overtime hours worked. Employers and employees cannot agree to a lower rate.
Yes, with a written overtime agreement. After September 1, 2019, banked time accrues at 1 hour per overtime hour worked. Before that date, the ratio was 1.5 hours per OT hour.
You must use banked time within 6 months of the end of the pay period in which it was earned, unless a collective agreement allows longer. If not used in time, it must be paid out at 1.5ร.
All outstanding banked time must be paid out at 1.5ร the regular rate at the time it was earned. The employer cannot require you to use banked time during the notice period unless you agree.
Yes. The same overtime rules apply to salaried and non-salaried employees. The effective hourly rate is calculated by dividing the salary by the hours it covers.
If paid exclusively by incentive (commission, piecework), the wage rate for overtime purposes is deemed to be the Alberta minimum wage. If salary + incentive, the salary establishes the rate if it's greater than minimum wage.
Ambulance, geophysical exploration, irrigation, logging, oilwell servicing, surveying, trucking, field catering, highway/railway construction, road maintenance, taxi cab, and firefighting services have different thresholds. See the table above.
Managers, supervisors, confidential-capacity employees, professionals (accountants, engineers, lawyers, etc.), certain salespersons (autos, real estate, insurance), farm workers, camp counsellors, domestic employees, and others. See the full list above.
No โ unless both parties agree. When termination notice is given, the employer cannot require the employee to use banked time during the notice period.
Banked time must be taken during non-overtime hours. The total of hours worked + banked time taken cannot exceed 8 hours/day or 44 hours/week (or the special industry threshold).
A sale of business does not affect the employee's overtime benefit entitlement. The previous owner pays accumulated overtime; the new owner grants banked time.
