What is the overtime rate?

Overtime pay is 1.5× your regular rate — often called "time and a half." For example, if you earn $25/hour, your OT rate is $37.50/hour.

Is there daily overtime?

No. Unless a written contract or collective agreement states otherwise, overtime is only calculated on a weekly basis (after 44 hours) or over a longer period under a written averaging agreement.

What is the "50 per cent rule"?

If you do a mix of exempt and covered work, you qualify for overtime only if at least 50% of your hours that week are in a covered category.

Can I bank overtime?

Yes, if you and your employer agree in writing, you can receive 1.5 hours of paid time off for each overtime hour worked. The time off must be taken within 3 months — or up to 12 months with written agreement.

What about public holidays?

If you work on a public holiday and are paid premium pay, those hours are not counted toward the 44-hour overtime threshold. If you take a substitute day off instead, those hours are counted.

Can my employer lower my rate?

No. An employer cannot lower your regular rate to avoid paying time and a half. You also cannot agree to give up your overtime rights under the ESA.

What if I have two different rates?

If you work two jobs at different hourly rates, each overtime hour is paid at 1.5× the rate applicable to the work performed in that specific hour.

Are managers exempt?

Managers and supervisors are usually exempt from overtime if their duties are managerial or supervisory. If they also do non-managerial work on a regular basis (not just occasionally), they may still qualify.

What is an averaging agreement?

An employer and employee can agree in writing to average hours over 2, 3, or 4 weeks. Overtime only kicks in when the average weekly hours exceed 44.
